It all over so I can talk about it now!!
This is the third time I have been chosen for my civil duty as a Juror.
This case involved a guy who was charged with selling counterfiet Nike sneakers.
Nike was not happy about this! Big wigs from Oregon came to this trial to testify!
First of all the prosecution needs all the evidence they can get in a case like this. They did prove that the merchandise sold in his store was counterfiet. The UPC codes did not match up with those at Nike.
The charge brought against the defendent was whether or not he KNEW they were counterfiet when selling them. He pleaded Not Guilty. After listening to two days worth of evidence, the only thing they could prove was that the sneakers were indeed counterfiet. He can't be held accountable unless they could prove he knew they were counterfiet. Okay... We all know he had to know they were fakes, but noone could prove it. So we couldn't put him away based on assumption.
After all, I have shopped a lot of places and found many purses, shoes and clothing that certainly looked like the real thing. I would not have known they were fake until someone told me what to look for. I also love to shop at liquidation sales and discount stores. Who doesn't! If I find a bargain I am stoked!! It's actually hard for me to pay full price for anything!! Maybe I'm spoiled or cheap, but I can't spend all my husband's money soley on a name or a brand when I can buy similar things at a lower price.
All that said, I will not buy counterfiet products and will try to avoid them at all cost. If I suspect that the product I am buying may be counterfiet, I won't buy it! there are serious consequences for this!
In this case, we had to render the guy "not guilty" based on the fact we couldn't PROVE that he knew they were counterfiet. If he did know, he hid it well!
